Terms of Use

Effective from March 1, 2022

ALEX has a new name from October 15, 2024 on. ALEX is known as Aalto EE Canvas Learning Environment. The new address of the learning environment is canvas.aaltoee.fi.

General

Aalto EE Canvas (”Canvas”) is a learning environment of Aalto University Executive Education Oy (“Aalto EE”) including inter alia the following services:

  • Canvas Learning (online learning environment for programs), and
  • Canvas e-Learning (online courses)

By using Canvas, the user (“User” or “You”) agrees to be bound by these terms and conditions (“Terms of Use”), as modified and placed on Canvasat any time by Aalto EE. When you register as a User and/or accept these Terms of Use, Aalto EE grants you a limited, non-exclusive, non-transferrable and revocable right to use Canvas.

The service is available until further notice after registration. The detailed terms of use per user account can be found at the section: “Obligations of the user”.

Data Privacy

Registering as a User and/or by using Canvas you also agree to our Data Privacy Policy which is a part of these Terms of Use. The Data Privacy Policy shall apply to the use of Canvas. Please read and accept our Privacy Policy prior to using Canvas.

Use of the Canvas Portal

Users may use Canvas  to review of their respective study attainment information including receiving of feedback related to their performance. Further the User has access to participation lists of the programs he/she is attending to.

In addition, Users have the possibility to decide on the visibility of alternatively linked services (e.g. Twitter) to other users.

The Aalto EE Canvas portal can be used for studying, for example, by:  

  • attending online courses,
  • taking part in exams,
  • utilizing available pedagogic material available in Canvas to complete studies and/or perform assignments contained in Canvas,
  • taking part in programs (trainings, exams) and/or academic discussions between other participants, program team and/or faculty,
  • reviweing event information and educational material and saving them for the User’s own purposes, and
  • viewing (but now downloading) of video material.


Obligations of the User

By registering as a User you agree to provide truthful and complete information to Canvas. Providing misleading or false information is forbidden. Further, you agree to keep your personal information up to date.

Your user account is personal. You agree to choose a strong and secure password, keep your password secure and confidential and your user account in personal use only. You are personally liable (i) for your user account and any use of Canvas; (ii) for any content you post to Canvas and (iii) for following the applicable law and these Terms of Use and iv) for any and all consequences thereof. In the event of misuse of your user account you agree to report to Aalto EE.

Further, you undertake not to directly or indirectly, (i) license, sell, lease, assign or otherwise transfer any of the contents on Canvas, (ii) alter or permit a third party to alter any part of the contents of Canvas nor to iii) disclose such material that due to its nature is clearly meant only for the distribution of the Users.

By submitting any content, information or feedback (“Material”) to Canvas you agree that you own the Material and have a right to publish it. You agree to obtain any necessary consent, permission or license for submitting any Material when required by law.

Aalto EE reserves the right to monitor or remove any Material you or other Users have submitted to or through Canvas. Due to our eventual inability to monitor or control all Material posted to or through Canvas or privately posted through Canvas, we are not responsible or liable for any Material any user submits to or through Canvas.

Any use or reliance on any Material posted through Canvas is at your own risk. We are not responsible for any truthfulness, completeness, accuracy or reliability of any Material posted through Canvas by you or other Users or by the opinions it represents. We are in no circumstances liable for the Material or any damages or loss of any kind as a result of the use of any Material posted or made available through Canvas.

You agree not to publish any unlawful, offensive or inappropriate Material through Canvas. For example, you agree not to create a false identity to Canvas or misrepresent your current or previous positions or qualifications. You also agree not to use or post anything that contains software viruses, worms, or any harmful code nor undertake any other unlawful or harmful actions.

You agree to respect the privacy of others when using Canvas and posting content to Canvas.

The user account will remain effective for the present. After the termination of your user account, Aalto EE reserves the right to delete any Material you have submitted to Canvas. Some traces or copies of the information or content you have submitted to Canvas may remain due to it being reposted or otherwise saved by other users of Canvas.

Availability of and Amendments to Canvas

Aalto EE reserves the right, in its sole discretion, to improve, correct and change the Canvas. During maintenance breaks or other times Canvas might not be available for use. Aalto EE may also decide to discontinue Canvas or any part thereof providing – unless unreasonable for Aalto EE considering the circumstances – a prior notice to you.

You agree that Aalto EE has no obligation to store, maintain or provide you a copy of any content or information that you or third parties provide unless required by applicable law or our Privacy Policy.

Third Party Links, Sites, and Services

We may have links to third-party websites or resources that are not owned or controlled by Aalto EE You note and agree that Aalto EE is not responsible for their availability or accuracy nor the content, unless it may be required by applicable law. Third-party links, sites and services have their own legal terms and privacy policies. You agree that clicking these links or using third-party sites or services is at your own account. Therefore, you are recommended to familiarize yourself with their legal terms and privacy policies before accessing or using any third-party links, sites and applications.

Restrictions

All data, content, information and materials that may be found in Canvas, including, but not limited to User information, logins and passwords, images, illustrations, graphics, photographs, audio clips, video clips, text, artwork, software or HTML code (collectively “Content”) are protected by privacy, confidentiality, trademark, copyright and/or other intellectual property rights or licenses held by Aalto EE, its affiliates or third parties who have licensed such materials and content to be used in Canvas.

The User acknowledges and accepts that use of Canvasdoes not in grant any rights or licenses to use such intellectual property. Especially, the User undertakes not to:

  • copy information of other Users nor create any registers of these,
  • re-publish any of the educational material (e.g. lecture material, handouts, assignments, instructions and articles and descriptions of practical cases protected by copyright and/or other intellectual property rights or licenses) outside of Canvas;
  • download and/or save the videos even for the User’s own use.

Security

We use our reasonable efforts to guarantee the security of Canvas. However, we cannot guarantee that unauthorized third parties will not be able to defeat our security measures. We ask you to inform us immediately of any unauthorized use of your user account or other security problems detected with Canvas.

Termination of User Account

You may terminate your user account if you no longer wish to use Canvas. In order to terminate your user account you may contact Aalto EE Canvas Support (canvas.support@aaltoee.fi). After the termination you will no longer have access to Canvas and your user account will be deleted.

Aalto EE reserves the right to terminate your user account and close it if a breach of the Terms of Use is indicated. You agree that after the termination of your user account, Aalto EE has no obligation to store, maintain or provide copies of any information or content you or others have provided, except what is required by applicable law and what is stated in the Privacy Policy.

No Warranty

You agree that Canvasis offered on ”AS IS” and “AS AVAILABLE” basis. Aalto EE disclaims all warranties and conditions, whether express or implied, of merchantability or fitness for a particular purpose, or non-infringement.

Aalto EE disclaims all responsibility and liability for: (i) the availability, timeliness, completeness, accuracy, security or reliability of Canvas or any of its content; (ii) any harm caused to your computer system or mobile system, loss of information or data or other harm resulting from your access to or use of Canvas or any of its content; or (iii) deletion of data, failure to store or to transmit any content or communication. We cannot guarantee a failure free use of Canvas or that Canvas will fill your requirements.

Indemnity

You agree to indemnify and hold harmless Aalto EE against any third-party claims or liabilities arising out of either (i) your breach of these Terms of Use; (ii) your infringement or violation of any intellectual property rights or other third-party rights or (iii) misuse of your user account due to not taking reasonable care of protecting your username or password.

DISCLAIMERS AND LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AALTO EE AND/OR THE PERSONS OR ENTITIES AALTO EE WORKS WITH AND/OR THAT WORK FOR AALTO EE ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, INFORMATION, OPPORTUNITIES, REPUTATION, PROFITS OR REVENUES, BUSINESS INTERRUPTION, INCONVENIENCE, OR INABILITY TO USE AALTO EE CANVAS EVEN IF AALTO EE WOULD HAD BEEN NOTED OF THE POSSIBILITY OF SUCH DAMAGES. IN SOME JURISDICTIONS SOME LIMITATIONS OF LIABILITY CANNOT BE MADE, SO THESE LIMITATIONS MAY NOT APPLY TO YOU. IN THAT CASE THE LIMITATION TO THE LIABILITY OF AALTO EE IS MADE TO THE GREATEST EXTENT THE LAW PERMITS.

Governing Law and Dispute Resolution

Except where prohibited by applicable law, you agree that the Finnish law is the governing law of these Terms of Use without regard to its principles and rules on conflict of laws.

Any dispute, controversy or claim arising out of or relating to these Terms of Use or the access to or use of Canvas shall be tried to be settled by means of negotiation. If the parties fail to resolve the dispute through negotiations, the dispute shall be settled in the District Court of Helsinki in the first instance.
